Was a professor of medicine at Harvard who aspired to change the law by becoming a judge. He was born on March 8, 1941, in Boston and, during his life, spent three years in the army.
His lectures eventually became “The Common Law,” one of his best-known writings. The common law’s operation is thoroughly explained in this book. Many tools are needed to complete the work at hand. There are several methods to justify a particular conclusion, but one of the most crucial is system consistency (Panzarella and Vona, 1947. pg. 140). Law is a manner of life, not a theory. According to Holmes, the Constitution gives the people the right to use their elected officials to enact whatever laws they see appropriate. He believed that judges shouldn’t have the authority to enact new laws. He was of the opinion that lawmaking power should not be delegated to the judicial branch.
